Life is unpredictable and so it is necessary to take actions before it’s too late. Living will gets activated when a person is no longer in a state to communicate or taking decisions for himself or herself and doctors diagnose that the condition will not reverse.

Who is eligible to write LIVING WILL in india?

An adult above 18 year who has healthy mind and in a position to communicate, relate and comprehend the purpose and consequences of executing the document can write Advance Healthcare Directive.

The person who is making the living will must not be compelled and must have full information about this law.

What Advance Healthcare Directive contains?

  1. This will contain the clear instructions that when to stop treatment. Who is eligible to take decisions for his or her behalf. 
  2. It should mention that the executor may revoke the instructions/authority at any time.
  3. It should disclose that the executor has understood the consequences of executing such a document.

How the living will is registered in india?

This will is  signed by the executor in the presence of two attesting witnesses, preferably independent, and countersigned by the jurisdictional Judicial Magistrate of First Class (JMFC) so designated by the District Judge concerned.

The JMFC shall preserve one copy of the document in his office, in addition to keeping it in digital format.
